Yes, but it was a Lexus RX-330 and I got back every cent I paid after 18 months and 18k miles, including tax and title fees..... and didn't have to resort to an attorney. IOW, it amounted to the free use of a new car for 18 months.
Your problem is the exact one I had with the Lexus. The clock starts ticking on the first day you complain. The dealer has a certain length of time and a set number of attempts to get it right - if he can't, you can claim lemon status so long as you've jumped through the right hoops and can demonstrate that the problem is either dangerous or will detract from resale value.
If you get a lemon judgement, you are charged back with a pro-rated amount of value from the date of purchase until your first complaint, figured over the life of the vehicle... in my case, I complained at 800 miles and when they tried to charge me for those miles I told them to shove it - the car came from the factory with the problem and the only reason I came in before the 1000 mile service was to make them aware of the problem which already been experienced - otherwise I wouldn't be there - so I got that $250 also. 
Do an internet search for Subaru + transmission problems, find out if they've been reported by others, what Suburu's position is on it and if you think it's worthwhile to go down that road, get your ducks in a row before you unload on 'em..... but when you do, use the big-bore stuff. 
The problem is widespread - Lexus, Volvo, Toyota, Jaguar and others - it's not all cars of the same type... one can be fine and the next one not. AFAIK, the industry still hasn't figured it out.
